East Kazakhstan Regional Court held a "round table" on the topic: "Actual issues arising in the preparation of the procedural agreement."

The "round table" was attended by the judges of the regional court, chairmen and judges of district and equivalent courts, prosecutors and lawyers.

Speaking at the meeting, K.Chakpantaev noted that the institution of procedural agreement (plea bargaining) found their own development. In the course of its application many questions rised that require answers in accordance with the law requirements. The urgency of the meeting due to the necessity of forming a unified judicial practice, a common approach to drawing up a procedural agreement, combating violations of the rights of victims and suspects. He emphasized that introduction of the institution of procedural agreements was an effective and timely step.

According K.Chakpantaeva, July 1, 2016, the courts of first instance region received 89 criminal cases with the procedural agreement, from which 87 criminal cases are already completed. In his opinion, this figure is necessary. If you compare the statistics with 2015, then there is an increasing trend of criminal cases in this category, only 82 criminal cases with the procedural agreement  were considered in 2015"- said K.Chakpantaev.

At the meeting, Aizhan Abuova, the judge of the judicial board on criminal cases, noted the adoption by the Supreme Court of the Regulatory Resolution number 4 on July 7, 2016 "On consideration of criminal cases by the courts in the conciliation process" that gives answers to many questions that arose in the course of law enforcement.

During the "round table" the reports and  reviews of criminal cases in conciliation production problems arising from the defense were discussed.
