Today, the Chairman of the Supreme Court Kairat Mami held a conference call with the Chairman of the Board of the National Chamber of entrepreneurs of Kazakhstan Ablay Myrzahmetov, the chairman of the supervisory board of the judiciary in civil and administrative cases of the Supreme Court Elis Abdykadyrov and judges of the Supreme Court.

Through video conferencing, the meeting was attended by judges of local courts and heads of regional branches of NCE.

Judges and entrepreneurs discussed issues of the execution of orders, voiced by President Nursultan Nazarbayev at the meeting with K.Mami held on 14 August of the current year.

From meeting K.Mami noted that the Head of the State at the meeting noted the special place of the judiciary system in protecting the rights of small and medium-scale businesses and investors. By the Head of the State were given orders to improve the work of Inter-district economic courts, improve the quality of domestic courts to settle disputes entrepreneurs, including foreign and domestic investors.

"This conference call is held jointly with representatives of the National Chamber of entrepreneurs to discuss available in this field issues and to develop measures to implement the orders of the Head of the state," - noted the Chairman of the Supreme Court, referring to the entrepreneurs.

The chairman of the board of NCE Ablay Myrzahmetov told about the interaction of entrepreneurs with the courts and the prospects for strengthening the work.

The chairman of the supervisory board of the judiciary board in civil and administrative cases of the Supreme Court Elis Abdykadyrov spoke about the work of the specialized economic courts, issues arising in proceedings in protecting the rights of entrepreneurs, including foreign investors.

In the past six months the maximum number of civil cases accounted for the economic courts of the city of Almaty and South Kazakhstan region. The Chairmen of Almaty city court Akzhan Eshtay and appellate judicial board on civil and administrative cases of South Kazakhstan regional court Madiyar Balken spoke about the features of the consideration of economic disputes.

The chairman of Atyrau regional court Mukhtar Smagulov also spoke at the meeting. In this region, the great bulk of foreign companies operating in the oil and gas industry. During the discussion it was noted that there were certain problems in the relations between the courts and enterprise, including the imperfection of the legislation. For example, on the effectiveness of the legal framework in challenging the state bodies influenced the lack of an independent effect of the Administrative Procedure Code.

Currently, we have prepared a draft Concept of APC, take other necessary measures, appropriate instructions will be given to local courts. During the meeting, discussion was held on the creation of arbitration courts. Order of the Head of the State on the formation of the legislative, institutional and material-technical base of their operation is implemented by the Chamber jointly with other interested bodies. K.Mami emphasized the constructive dialogue on the topical issues of practice considering civil cases where the parties or one of the parties are the representatives of business, foreign companies. In particular, the Chairman of Supreme Court noted: "The Head of the State pays special personal attention to the protection enterprise. Decisive role in this is played by the judiciary system. Therefore, the main task of courts is quality and timely consideration of civil cases in this category in the regions, improving the efficiency of the economic courts. "

In general, participants noted that the qualitative implementation of orders of the President of the country, aimed at the protection of the rights and interests of entrepreneurs and foreign investors can only be achieved through joint efforts.
