There was an enlarged meeting with participation of Kairat Mami in Almaty city court

Today in the Almaty city court there was a meeting of judges of Almaty city following the results of administration of justice in 2015.

The Chairman of the Supreme Court Kairat Mami, chairman of Almaty city court Akzhan Eshtay, the judges of the city, management and employees of the court of office took part in the event.

The chairman of Almaty city court A.Eshtay opened the work of the meeting. In his speech he talked about the results of the administration of justice by courts of the city over the past year.

In particular, he noted that in 2015 the courts of Almaty city received more than 150 thousand lawsuits that 6000 cases more than in the same period of 2014. The main reason for the increase of cases, according to A.Eshtay is joining Almaty city a number of rural districts and towns of Almaty region. The increase did not result in deterioration in the quality of administration of justice. In addition, during the reporting period reduced the number of decisions passed in absentia. In 2015, in absentia was passed 11 728 decisions, while in 2014 - 22 658 decisions.

Head of the Office of Almaty city court B.Asanbekov informed the participants about the work done on the introduction of electronic justice. In 2015, the courts received 20,784 applications in electronic form that almost 47% more than in 2014 (11 029). Successfully it is implemented the promptly notification project of participants in proceedings by sending them via the subpoena e-sud. Over the past year the courts of the city sent parties 200,288 SMS notifications. This greatly reduced the budgetary cost.  

Also during the extended meeting had been heard reports of some chairmen of district and equated courts of Almaty city.

Chairman of the Supreme Court Kairat Mami summed up the meeting. He informed the participants about the implementation of Plan of Nation "100 concrete steps - the modern state for everyone" for each of the 11 steps, focused on respect of the rule of law. Particular emphasis was placed on the work on updating the law, the formation of high-quality judiciary, the transition to the three-tier system of justice, equipping court rooms by audio and video recording systems.

"The implementation of Plan of Nation significantly improve the efficiency of courts and allow judges to ensure the quality of administration of justice", - K. Mami said.

In his report, the Chairman of the Supreme Court gave an assessment of the main indicators of courts of Almaty in 2015. It was noted some improvement in the quality of the courts work of the city and the overall positive dynamics of the quality of administration of justice.

There are results in the personnel policy of the court. So, for the past three years, about 40 employees of the judiciary had been appointed judges from Almaty. This is almost 75% of the total number of newly appointed judges of the city.

However, there has been noted a number of disadvantages, over which it should work. In particular, there has been some deterioration in the quality of courts work in civil cases. For example, 54% increase in the number of civil cases in the period of more than 6 months. In addition to the Economic Court, the highest number falls on the court №2 of the Auezov district (17), the Medeusky (12) and the Zhetysu (12). In addition, 78% of the republic suspended civil cases accounted for Almaty.

In courts of the city, despite the large number of considered cases, there is very little used conciliation and mediation.

Also it had been revealed shortcomings in the administration of criminal justice and the appellate court. There is a high turnover among employees of the Office of the courts.

Before the judiciary it had been set a number of tasks for the current period.

Chairman of the Supreme Court emphasized that the courts will have the hard work associated with the implementation of Plan of Nation. Particular attention will be paid to the regional courts in significantly changed conditions of administration of justice, when the quality of justice in a particular region will be clearly visible on the basis of appeal. "For me the main thing is not the number or percentage of canceled judicial acts, but citizens' confidence in the regional courts. The responsibility of the regional court to the population increases significantly because some of the cases the Supreme Court is not the jurisdiction ", - K. Mami said. He drew attention to the work on quality personal reception of citizens, permanent analysis of judicial practice, work with the mass media, and the e-justice development.

It was also noted that most of the responsibility lies with chairmen of the divisions of appeal. "The appeal in recent years has lost its key role in the justice system. Meanwhile, it is this instance should become the most authoritative and decisive, as is customary in the world "- the Chairman of the Supreme Court noted.

Within the framework of the meeting, judges’ attention was drawn to the need ensure the legality of all complaints and legal claims related to violations of the election legislation. It is particularly noted that such cases are subject to consideration in a short time and it will require increased efficiency from the judges. At the same time the resolution of such cases is unacceptable incorrect application of substantive and procedural law.

The Chairman of the Supreme Court noted that many worthy local courts judges who have a wealth of professional experience and knowledge. It should be able to use the existing potential for the strengthening of the rule of law in our country. "The judges, as carriers of the judiciary must continually expand their horizons, to keep abreast of modern trends of development of law and jurisprudence, including the international" - K. Mami made sure.

He expressed hope that this year the judges of Almaty provide quality implementation of all tasks.
