The Military court recovered from the former serviceman 1.5 million tenge spent for his training

The military court of the Ust-Kamenogorsk garrison considered the civil case on the legal claim of the representative of the State Border Service of the Committee of National Security of the Republic of Kazakhstan on issuing a court order to recover money from the former serviceman M. in the amount of 1 496 933 tenge spent for his training at the Academy of Border Service of the National Security Committee RK.

The applicant indicated that by order of the head of the Military Institute of the NSC RK, M. was enrolled in the lists of the institute's cadets, a contract was signed on his military service for 10 years after the end of the military educational institution. Thus, he accepted the obligation, after graduating from a higher military educational institution, to perform military service for 10 years in the positions of officers.

In 2014, after graduating from the Academy, Lieutenant M. was appointed to the position of deputy head of the educational and socio-legal work of the frontier post of military unit 20 .. PS NSC RK. However, by the verdict of the military court of the Ust-Kamenogorsk garrison, serviceman M. was sentenced to imprisonment for committing a crime stipulated by part 3 of Article 345 of the Criminal Code of the Republic of Kazakhstan and accordingly was dismissed from military service.

According to c. 13.1.1 of the Article 26 of the Law of the Republic of Kazakhstan "On military service and the status of servicemen", "the conviction of a court that entered into legal force for the commission of a crime, including conditionally, is grounds for the dismissal of servicemen from military service for negative reasons ".

Based on the court order of the military court, the debt from the debtor to the state income is recovered in the amount of 1 496 933 tenge.
