The rights of the disabled serviceman are protected

The decision of Semey city court considered case on Karatayev S. T. claim to troop unit of 5511 Internal troops of the MIA of RK about indemnification caused to health, by collecting, monthly, earnings lost.

So, the claimant went to court with the claim for compensation of the earnings lost, monthly since January, 2015 before achievement of a retirement age by him of 26 604 tenge, motivating with that 29.12.2011 at execution of office tasks, namely when performing expeditious actions, on withdrawal at the convicted forbidden subjects, identification of places of their storage, detection of mines, hiding places and caches, he got the penetrating wound in the right eye. According to the conclusion of a forensic medical examination, heavy injury was caused to him.

By the conclusion of the medical commission of Department of internal affairs, the diagnosis was confirmed and the claimant was disqualified for military service.

According to the conclusion of the medico-social commission the claimant is recognized as the disabled person of 3 groups with loss of 59% of occupational capacity.

On February 19, 2015 he was re-examined, and recognized as the disabled person of the third group, without re-examination term. However, by the respondent it was refused payment in spite of the fact that by the judicial act which already entered into force it was established about a duty in payment.

Average earnings, to a mutilation made 90 183 tenge. The size of the pension received now makes 14 667 tenge. The earnings lost make 53 208,5 tenge.

The difference between the lost earnings and the received pension makes 38 542 tenge.

Taking into account it, Karatayev’s S. T. requirements were satisfied. It is collected from a troop unit of 5511 Internal troops of the Ministry of Internal Affairs of RK, monthly, since January 29, 2015 the earnings lost in the sum of 26 604 tenge before achievement of a retirement age by him.
