Decision of the court of Aktobe city restored the rights of the plaintiff in the former position

Today in the court of Aktobe city considered a civil case on the claim Burtibaeva N. to akim of Aktobe city, PI "Apparatus of Akim of Aktobe city " to cancel the order and reinstatement.

Plaintiff motivates claims that the order of Akim of Aktobe city  on 19 June 2014 it was decided to dismiss her from her post of the head of the city department of employment and social programs. In this case, the order of the Akim of Aktobe city from 10 June of 2014 in connection with the temporary disability of the claimant the duties of the head have been temporarily assigned to other person.

Employment relationship with the plaintiff were terminated at the time of disability from 10 June to 24 June 2014, while the legislation of the Republic of Kazakhstan the termination of the labour contract of employment is not permitted by the employer during the period of temporary disability of the employee, in connection with which Burtibaeva N. was forced to go to court to protect her rights.

Court of Aktobe city was decided to cancel the order and to restore the plaintiff's right in the former position.

The court's decision did not enter into force.
