Aktobe city court recovered wages from the football club in favor of a professional footballer

T. went to Aktobe city court against the regional football club "Aktobe" on the obligation to make payment of 11.106 million tenge - wages for November and December 2015, 483 224 tenge - penalties for delayed payment of wages, 5.553 million tenge - compensation for unused days of annual paid leave for 2015 and 207 096 tenge - penalties for late payment in connection with the employment contract termination

The Court found that the January 3, 2014 JSC "Regional football club Aktobe" and T. concluded a contract of employment under which T. performs work as "a professional football player" for remuneration and compliance with work schedule, and the employer - provide conditions of work, timely and full payment of wages T. and performs other payments stipulated by the labor legislation, the employment contract, the parties' agreement.

Duration of the agreement is set: from January 3, 2014 to January 3, 2015.

The plaintiff, in the framework of a labor agreement in good faith performed labor functions and obligations of his qualification, however, the defendant failed to fulfill obligations under the terms of the contract, there are gross violations of the current legislation with regard to payment of wages T.

The employment relationship between the plaintiff and the defendant were canceled January 4, 2016, in accordance with the agreement and the plaintiff transition to a new job.

In accordance with paragraph 4 of Article 113 of the Labour Code when the termination of the employment contract the payment of the amounts due to the employee by the employer shall be made no later than three working days after its termination, i.e. payment had to be made by 11 January 2016. However, the defendant has not made payment.

Penalty for delay relying compensation to the claimant for the period from January 11, 2016 on April 18, 2016 amounted to a total amount of 207 096 tenge.

Aktobe City Court, having considered this civil case, pursuant to Articles 223, 226, 281 of Civil Procedure Code, decided to satisfy T. legal claims partially.

The Court recovered from JSC "Regional football club Aktobe" in favor of T. 11,106,000 tenge (wage arrears), 305 415 tenge (penalty for delayed payment of wages) and 5.553 million tenge (compensation for unused days of annual paid leave for 2015).

With FC also recovered 169,644 tenge (state fee) to the state revenue.

The rest of the legal claim is denied.
