At the South Kazakhstan regional court they discussed the matters of application of land legislation

The chairman of the Judicial division for Civil Cases T. Bekmimbetov, judges, representatives of the Prosecutor's Office, akimats, the Management and the Department of Land Relations, the Chamber of Appraisers, the Department of Land Cadastre and the Technical Survey of Real Estate branch of the nonprofit JSC "Government for Citizens" and the media took part in the work of the "round table" on: "Actual problems of land legislation application".

Speaking, T. Bekmimbetov accentuated the participants' attention to the annual increase in the number of land disputes, named the reasons for their occurrence. They included the untimely registration of title documents on land plots allowed by authorized state authorities for omissions and errors, incompleteness of information of the land cadastre, including legalization of immovable property, etc. These questions with the purpose of determining the ways of their solution T.Bekimbetov called the participants of the " round table " to carefully discuss.

Judges of the regional court B.Tanirberdiev and A.Alshynbaev, as well as Karatau and Abai district courts E.Agmanov and M.Sharipov in their speeches in detail spoke about the issues of judicial practice in the resolution of land disputes. They gave specific examples when local executive authorities, taking decisions on the provision of land plots in private ownership, permanent use, temporary paid or gratuitous use, and then by state authorities exercising protection and control over their use, seized land plots from former owners in violation of the law.

The specified infringements, in view of non-observance of requirements of the law at registration, the coordination, the statement at granting of the ground areas, and also at withdrawal of the ground areas for needs of the state, generate a dispute, and as consequence mistrust to the state authorities from the population.

The representatives of the prosecutor's office, the heads of the akimats, the Management and Shymkent City Department of Land Relations also made presentations. In their speeches they suggested making some amendments to the land legislation.

There was a constructive exchange of views, the participants of which prepared relevant proposals and conclusions for sending to state authorities and organizations.
