In the South Kazakhstan Regional Court there was a workshop

South Kazakhstan Regional Court held a workshop on: "Problems arising from the bankruptcy and rehabilitation, as well as the settlement of the financial insolvency of the debtor", with the participation of the judges of the regional and specialized inter-district economic court of SKR, representatives of the Department of State Revenue of the South Kazakhstan region and Chamber entrepreneurs.

In his report, chairman of the Appeals Board on civil cases T.Bekimbetov focused on the features of the latest developments in the Rehabilitation and bankruptcy law, he has paid attention to the problems of bringing to vicarious liability of the debtor (party) and (or) officials. Pointing out that these issues affect not only economic development, but also the correct flow of revenues to the budget, urged the participants to discuss these issues with a view of uniform application of bankruptcy legislation.

In the course of the workshop the judges of specialized inter-district economic court of SKR paid special attention to the practical application of the abovementioned legislation, gave specific examples for consideration of civil cases of bankruptcy and rehabilitation, focusing on the shortcomings in the bankruptcy of managers, made proposals for improving their functioning and the observance of the terms of bankruptcy proceedings.

Also, the recent changes in the Rehabilitation and Bankruptcy laws were discussed, pointed to the lack of clear requirements in the legislation in the appointment of temporary administrators, there are problems in identifying the bankruptcy estate of the bankruptcy managers, practice to identify false bankruptcy and other issues.

The participants unanimously agreed on the need for regular meetings and discussion of urgent issues for rapid resolution.
