The sentence was left unchanged

The appeal judicial board on criminal cases of West-Kazakhstan regional court considered an appeal of the former chief of the regional administration of tourism, physical training and sports Muslim Undaganov, who was sentenced for 12 years of freedom deprivation by the first instance court.

Together with M.Undaganov on the case of theft of budget funds, which were assigned for development of sports in the region, there were a director of the regional school of Olympic reserve Konys Zhetpisov, as well as a chief of the department on study-sports work of the administration of tourism, physical training and sports of the region Turarbek Bekarystanov and director of the School higher sports mastery Mendikhan Dzhakenov. All of them made recourse to the appeal board of the regional court with an appeal.

By the sentence of the specialized inter-district court for criminal cases WKR as of 18 February 2014 all of them were convicted in theft of budget funds in the amount over 170 million Tenge.

The court convicted M.Undaganov in committing crimes under art.art.235 p.3, 176 p.4 sub.c. «a, b», 314 p.2, 193 p.3 of the Criminal Code RK. He was imposed penalty as deprivation of freedom for 12 years with confiscation of property, with deprivation of the right to hold positions in state institutions within five years with service of sentence in correctional colonies of strict regime.

M.Dzhakenov was sentenced to 11 years of freedom deprivation, K.Zhetpisov and T.Bekarystanov were sentenced to 8 years of freedom deprivation – each, with confiscation of property and with deprivation of the right to hold positions in state institutions within five years with service of sentence in correctional colonies of strict regime.

On 8 July by the resolution of the appeal board on criminal cases of West-Kazakhstan regional court the sentence regarding all four convicted was left unchanged.
