The courts of the Akmolinsk region considered the criminal cases with the application of Law "On amnesty in connection with the twenty-fifth anniversary of Independence of the Republic of Kazakhstan"

December 13, 2016 President of the Republic of Kazakhstan signed the act "On amnesty in connection with the twenty-fifth anniversary of Independence of the Republic of Kazakhstan."

According to the Law from punishment exempt persons who have committed criminal offenses and minor offenses, minors convicted of average severity offenses, pregnant women, women with minor children or disabled children, as well as men, are a single parent of minor children, the disabled I, II and III group, women aged fifty and older, men aged sixty and older, participants and invalids of the Great Patriotic war and the persons equal to them, widows of servicemen who lost their lives in the performance of military and (or) international duty, as well as women having husbands -disabled of war and persons equated to them.

The law does not apply to crimes against sexual inviolability of minors, terrorism crimes, extremist crimes, torture; persons to whom the death penalty is replaced by pardon with imprisonment, lifelong imprisonment; earlier application of amnesty or pardon, again committed a premeditated crime, a crime as part of criminal groups, espionage, terrorist acts, sabotage, mercenary activities, smuggling, etc.

In connection with the publication of the above mentioned Law the district and equated courts of the Akmolinsk region considered the criminal cases with the amnesty application.

For example Esil district court considered the criminal case with the use of amnesty against the men for illegal possession without purpose sales of narcotic drugs (Article 296 part 2 of the Criminal Code of the Republic of Kazakhstan). Kokshetau City Court considered the criminal case against a woman who is the mother of the minor children for acceptance of a bribe (Article 366 of the Criminal Code of the Republic of Kazakhstan). Bulandy District Court considered the criminal case with the use of amnesty for the driving of a motor vehicle in alcohol intoxication (Article 346 part 1 of the Criminal Code of the Republic of Kazakhstan). Shortandy district court considered the criminal case against the men for failure to fulfill obligations to pay alimony (Article 139 of the Criminal Code of the Republic of Kazakhstan). Atbasar district court considered the criminal case against a woman who is the mother of the minor children for the murder in the heart of passion former spouse (Article 101 part 1 of the Criminal Code of the Republic of Kazakhstan).

By the courts decisions criminal cases against the above mentioned accused under Article 6 paragraph 1 of the aforementioned Law were terminated.
