East Kazakhstan Regional Court restored the child’s rights left without parental care

East Kazakhstan Regional Court considered the civil case under the legal claim of CSI "Novoshulbinsky Regional Orphanage" Department of Education of EKR in the interests of a minor child Olesya Artamonova to Lyudmila Marchenko for reinstatement of the default of term for acceptance of the inheritance.

According to the case file, March 22, 2015 Olesya Artamonova grandmother died - Taisia Petrovna Artamonova. At that moment, a granddaughter brought up in an orphanage CSI "Novoshulbinsky Regional Orphanage", she had not other relatives. In order to protect her interests, namely the registration of inheritance Orphanage appealed in court.

However, by the first instance court decision the legal claim was denied due to lack of grounds for the restoration of the default of term for acceptance of the inheritance.

East Kazakhstan Regional Court considered this civil case, came to the conclusion that the CSI "Novoshulbinsky Regional Orphanage" deadline for submitting an application for acceptance of the inheritance has been missed for valid reasons. The reason was the finding of missing family relations and change heir’s names.

In this regard, the Court has restored the orphan’s rights - a minor O.Artamonova regarding acceptance of the inheritance.
