The court in Atyrau has instructed the car dealer to replace the car with a new one to his owner

G. went to Atyrau city court with a legal claim against LLP "B" and the Insurance Company about the requirement to replace the burnt out car with a new one and recognize the fire as an insurance event.

In the course of the trial it was established that in July 2016 the plaintiff purchased a UAZ 23632-249 car with a loan in the Bank at the motor show "B". A month later the car on the run ignited and was completely destroyed. The insurance company denied the claimant payment of insurance, referring to the absence of an insurance event. The car dealership also ignored the plaintiff request to replace the car.

However, the forensic fire and technical expertise found that the fire was in the engine compartment of the car, followed by the spread of current wires.

The court granted the legal claim for replacing the damaged car with a new one, refusing to recognize the fire as an insurance event.

The court's decision did not come into legal force.
