At the Supreme Court there was an expanded meeting on the outcomes of administration of justice for 2016

Today, at the Supreme Court there was an expanded meeting of the judges of the highest judicial authority on the outcomes of administration of justice for 2016 "On the implementation of the tasks set by the Head of State at the VII Congress of Judges of the Republic of Kazakhstan."

The Deputy Head of the Administration of the President Talgat Donakov, chairman of the Supreme Judicial Council Anatoly Smolin, the Human Rights Commissioner Askar Shakirov, judges of the Supreme Court, chairmen and administrators of the regional courts, the leadership of the Union of judges and the Department on support of the courts activity under the Supreme Court took part in the event.

Opening the meeting, the Chairman of the Supreme Court Kairat Mami noted that the year 2016 marked the beginning of a new stage of development of the judicial system of Kazakhstan, under which provided the practical implementation of institutional reforms in the rule of law. The past year also marked the holding of VII Congress of Judges, where the priorities of the judicial system development in the future identified.

Speaking about the main directions of the judicial and legal system development, Chairman of the Supreme Court spoke about the working group activities on the matters of redistribution of powers between branches of government powers created by the Head of State January 11, 2017.

K. Mami stressed the importance for our country, the institute of presidential power, stressing that "this is provided for by our Constitution, and it suggests the development of our present, our history, culture and traditions."

The new stage of development of the state objectively raises the question on strengthening the responsibility of Parliament and the Government for the state of affairs in the country. The judicial branch of power will also make a significant contribution to the modernization of the political and legal system of the country. The first proposals of the Supreme Court deal with the matters of the judicial system and legal proceedings, the judicial system relations with the Government, the Parliament and other state authorities. In this regard, it will expect a lot of work for a broad discussion of the proposed measures, to ensure the legislative redistribution of powers.

Within the framework of the event, the chairmen of the judicial divisions of the Supreme Court Elis Abdykadyrov, Abay Rahmetulin and Aigul Kydyrbaeva made reports on the outcomes of the administration of justice on civil, criminal, administrative and investment disputes for 2016.

Also a judge of the Supreme Court, chairman of the Judicial jury Moryak Shegenov, chairman of the Supreme Judicial Council Anatoly Smolin, rector of the Academy of Justice under the Supreme Court Murat Beibitov and head of the Department on support of the courts activities under the Supreme Court Abay Toksaba made reports at the meeting. In addition a number of chairmen of regional courts made reports within the framework of the meeting.

At the end of the event the Chairman of the Supreme Court Kairat Mami spoke. He summarized the main outcomes of 2016 and set a number of tasks for the current perspective.

According to the Chairman of the Supreme Court, the common term of passage of civil cases in courts is reduced by half, more than 82% of civil cases are completed in the first court trial. 43% increase the number of cases of writ of production, 68% - completed with the use of alternative methods of dispute resolution, almost 3 times - with the use of mediation. 59.2% of the cases considered in order of summary procedure, without calling the parties in court. Almost a quarter of a reduced number of cases considered with the participation of the public prosecutor.

In criminal legal proceedings 14% increase in the number of cases dealt with in an accelerated pre-trial investigation, 10% - in the conciliation proceedings, a more than 2 times - in a shortened procedure. In two thirds more terminated cases using mediation. At the 11.9% increase in the number of criminal cases considered by jury. Courts increasingly began to use alternative forms of punishment. Only by entered into legal force the sentences imposed fines amounting to more than 3.8 bln. tenge. Deprivation of freedom is applied only for a quarter of the convicts.

Progress has been made measures to enhance the competitiveness of the process, the expansion of judicial control. Over the last year in 2,6 times increased the number of materials on sanctioning considered by the investigative judges.

It was noted that the overall number of received applications to the courts and cases in comparison with 2015 has increased and amounted to over 1 million. 160 thousand, of which about 810 thousand cases and applications in civil proceedings, which is 10.8% more than in 2015. Over the past 5 years, the number of civil cases considered by the courts has increased by a quarter or 200 thousand cases. In this regard, Kairat Mami stressed the need to develop measures to reduce the burden of the judiciary load, including via the development of mechanisms of extra-judicial dispute resolution in the framework of the President's instructions given at the VII Congress of Judges.

K. Mami focused attention on the need for further improvement of e-justice. The task was on the development of Strategy for the judicial system informatization for the next five years. Within the framework of this document is supposed to launch the Situation Centre of the judiciary authorities, implementation of the model electronic courtroom, transition of legal proceedings fully to electronic format.

Within the framework of the final meeting 25-27 January 2017 held enlarged meetings of divisions of the Supreme Court on matters of criminal, civil, administrative and investment proceedings, summarizing the work of the Department on support of the courts activity under the Supreme Court and its territorial divisions for the 2016 year. In addition, the seminar – meeting of the judges with the participation of international experts was organized.

At the end of the event there was a ceremony of awarding the winners of the Republican contest for the best organization of the regional, district and equivalent court for 2016, conducted by the Union of Judges.

As a result of competition among the district courts specialized economic court of Astana took first place, the Oktyabrsky district court of Karaganda region took second place, the Kostanay district court of Kostanay region took third place.`

Among the regional and equivalent courts the North Kazakhstan regional court awarded the first place, the second place - Atyrau regional court and the third place - West Kazakhstan regional court.
