Supreme Court developed a Concept of the new Administrative Procedure Code

Pursuant to the instructions of the Head of the State, announced at the VI-th Congress of judges in November 2013, the Supreme Court began to develop Administrative Procedure Code.

At present, prepared and submitted for approval to the appropriate governmental authorities the concept of a regulatory legal act.

The new code will be legally regulated interaction of individual public institutions and citizens with the authorities. This will achieve the objective of the creation in Kazakhstan on the basis of active specialized inter-district administrative courts (SIDC) of the system of administrative justice.

By jurisdiction SIDS offered include cases against decisions and actions (or inactions) of state authorities, local self-government officials and civil servants, resulting in disturbed or created obstacles for the implementation of the rights and freedoms of the applicants, illegally charged any duty or unlawfully brought to justice.

In the project APC planned to enable of civil procedural law legal rules governing disputes between individuals and the public administration. This production by the statements on the protection of the electoral rights of citizens and public associations participating in the elections, referendums, proceedings in cases challenging the decisions and actions (or inactions) of state authorities, local self-government officials and civil servants. The production cases challenging the legality of regulations, appeal the prosecutor's recognition of acts and actions of bodies, officials illegal.
