Senate of the Parliament approved the draft laws developed by the Supreme Court concerning the judicial system

Drafts of the Constitutional Law "On Amending Certain Constitutional Laws" and the draft Law "On Amendments and Additions to Certain Legislative Acts of the Republic of Kazakhstan on the Supreme Judicial Council activities of the Republic of Kazakhstan and Astana International Financial Center" were developed by the Supreme Court in order to execute the President's instruction on the further implementation of the Plan of Nation, given at the meeting on 14 June 2016.

The Draft Constitutional Law amended the Constitutional Law "On the Judicial System and Status of Judges of the Republic of Kazakhstan" aimed at improving the measures taken based on the results of the periodic evaluation of the judges professional activities. In order to further improve the qualitative composition of the judiciary corps, to improve the evaluation mechanism and to stimulate the growth of professional qualifications, changes were made to ensure the release of the judge from the position in the event that a negative result of the periodic evaluation of his performance was obtained without re-evaluation.

The procedure for transferring judges to another court is regulated without a tender, if the Judicial Jury decides to transfer the judge to another court or to another specialization. An amendment has been introduced, which makes it possible for judges to retire teaching, scientific and other creative activities in budget organizations without suspending payment of monthly lifelong imprisonment. The proposed changes will make it possible to use the practical experience of such judges in the training of judicial personnel by involving them in teaching activities at state universities, including the Academy of Justice under the Supreme Court.

The competence of the Department on support of courts activities has been regulated in order to approve the procedure for using budget funds to support the International Council activities.

There are provisions related to the postponement of the introduction of universal declaration from January 1, 2017 as of January 1, 2020.

Amendments have been made to the Constitutional Law "On Astana International Financial Center" clarifying the wording of the law in connection with the change in the source of financing for the AIFC. The concepts of "identification number" and "registry of Identification Number Center" have been implemented.

In order to ensure flexibility in the adoption of AIFC acts made changes, according to which, the Center's authorities have the right to issue relevant acts.

Within the framework of the Law "On Amendments and Additions to Some Legislative Acts of the Republic of Kazakhstan on the Supreme Judicial Council Activities of the Republic of Kazakhstan and Astana International Financial Center" ", the powers of the Supreme Judicial Council of the Republic of Kazakhstan to review the submissions of the Chairman of the Supreme Court on dismissal of the judge in case his refusal to transfer to another court, to another specialization, in making such a decision by the Judicial Jury.

The adoption of laws will help increase the responsibility for strengthening the rule of law in the administration of justice by judges, and the improvement of legislation regulating the selection of judges by judges.
