A republican dispute-forum on the issue: "The role of mediation in the modernization of society" was held in Shymkent

Dispute-forum was organized by the Assembly of the people of Kazakhstan and the akimat of SKR.

The head of the Secretariat of the APK of the Presidential Administration Darkhan Mynbai, the deputy of the Mazhilis of the Parliament Bakhytzhan Abdraiym, the akim of the region Zhanseit Tuimebayev, the representatives of the Supreme Court, the General Prosecutor's Office, the Ministry of Education and Science, the "Kokhmady Kelisim" RSI, the Mediation Council of the APK, the akims of districts and rural districts of the region, the judges of South Kazakhstan and East Kazakhstan regions participated in its work.

Opening the forum, B. Abdraiym stressed the importance of further development of the institution of mediation in the context of modernization of public consciousness. The Deputy Chairman of the APK D. Mynbai and the region akim Zh. Tuimebayev stressed the necessity to discuss the possibilities for improving this institution in such a wide format.

Also during the event, the director of the "House of Friendship – the Center of Public Consent" СSI the administration of the akim of the East Kazakhstan region Eldar Toleubekov, a senior assistant to the General Prosecutor Saltanat Tursynbekova and deputy head of the administration of the akim of the South Kazakhstan region Muratali Kalmuratov made a report. The speakers noted the main achievements in the implementation of the Law on Mediation, the implementation of the above-mentioned pilot project, stressed the role of the mediator in ensuring public consent.

Speaking at the forum, the chairman of the regional court Talgat Baratbekov noted that a number of disputes are resolved peacefully in the framework of the pilot project on the introduction of pre-trial settlement of disputes (conflicts) in certain categories of disputes in the mediation as well as in the light of innovations introduced in the procedural legislation. As T. Baratbekov noted that during the implementation of the pilot project in the first half of this year the courts of the republic received 2,178 cases, applications regarding the interests of the child considered with a decision were 736, 540 cases were completed in the mediation procedure, 356 agreements were approved in the course of judicial and 271 with the application of obligatory mediation.

4,506 cases and applications were received on Labor disputes (according to the procedure of clause 1 of Article 159 of the Labor Code of the Republic of Kazakhstan), 2,025 of them were considered with the decision, 675 were completed in the mediation procedure, 514 agreements were approved in the procedure of judicial mediation and 354 with obligatory mediation.

3,081 cases and applications were received on inheritence, 2,008 of them were considered with a decision, 109 were completed in the mediation order, 78 agreements were approved in the course of judicial mediation and 34 with obligatory mediation.

34,458 cases and applications were received on divorce and division of property, 21,895 cases of which were considered with a decision, 3,824 cases were settled in mediation proceedings, 2,584 agreements were approved in the course of judicial mediation, 1,884 with application obligatory mediation.

28,021 cases and applications were received on the loan agreements, of which 21,143 were considered with taking a decision, 1,156 were completed in order of mediation and 1,155 agreements were approved by way of judicial and 939 with the application of obligatory mediation.

2,214 cases and applications were received on insurance disputes, 1,586 of them were considered with a decision, 61 were completed in the mediation procedure, 45 agreements were approved by judicial mediation and 18 with obligatory mediation.

The courts are doing a lot of work on application of the conciliatory procedures. Thus, the courts of the republic completed 34 849 criminal cases during 8 months of this year, 7 643 were considered with the participation of mediators. 18,122 civil cases out of the completed 555,418 were terminated due to a mediation settlement agreement.

The participants of the event made their specific proposals on the development of mediation in the republic.

The ceremony of signing Memorandums between the Mediation Council of APK and the Akimat of the South Kazakhstan Region as well as the Mediation Council of APK and the National Chamber of Entrepreneurs of the Republic was held during the forum.

In the result of work, the forum participants developed recommendations on further improvement of the legislation and development of the mediation institute.
