At the military court on criminal cases they discussed matters of non-enforcement of judicial acts

The specialized inter-district military court for criminal cases held a "round table", during which its participants discussed the state of execution of judicial acts, problematic issues and ways to resolve them.

Deputy Director of the Department for the Execution of Judicial Acts of the Ministry of Justice R. Balgazin, Prosecutor of the Department for Supervision of the Legality of the Executive Proceedings of the Prosecutor General's Office E.Torsykbayev, Head of the Office of the Main Military Prosecutor's Office for Representation of State Interests in Court D.Zhumagulov, Deputy Head of the Department of Justice of Astana N. Aringazhinov, the officer of the court of the territorial department of accounting and organization of work on the arrested property in Astana city JD Astana B.Alpanov, deputy head of the Regional Chamber of Private officers of the court of Astana A.Beysenbaev took part in the event.

The chairman of the court, E.Akhmetzhanov, opening the event, noted that the timeliness of execution of judicial acts affects the effectiveness of justice, the emergence of doubts in this contributes to each unfulfilled court decision, and therefore stressed the relevance of the topic under discussion. He informed about the problematic issues of enforcement of judicial acts issued by the court in 2010 and invited the participants, together, to identify concrete measures to eliminate existing shortcomings and ensure the timely execution of judicial acts.

Judge B. Daribaev in his report on the state of enforcement of judicial acts reflected statistical data and identified the reasons for non-execution of individual industries. At the same time he noted that violations of the terms of execution of executive documents and lack of information about the stage of execution and motion of the writ of execution led to the failure of most judicial acts. Separately, he dwelt on information on the so-called "Khorgos case", according to which dozens of units of movable and immovable property, as well as multi-million sums of money, have not been confiscated and not returned to the state's income.

Participants of the event expressed their views on the topic under discussion and identified a number of reasons and problems that hampered the realization of the legitimate interests of the recoverers, and made proposals for their elimination.

As a result of the discussion, the participants in the round table agreed that effective cooperation between the court and government agencies to ensure the enforcement of judicial acts is needed to improve the effectiveness of judicial acts, and a number of joint measures are planned to eliminate the identified shortcomings.
