Judges of the East Kazakhstan regional court discussed changes in legislative acts

The East Kazakhstan regional court held a discussion of the Law "On Amendments and Additions to Some Legislative Acts of the Republic of Kazakhstan on Improving Civil, Banking Legislation and Improving Conditions for Entrepreneurial Activity."

In the course of the seminar, the chairman of the judicial division for Civil cases M.Komirshinov noted that the changes introduced are significant, in particular, changes to the Civil Code (general and special part), regulate the concepts of a disputable and void transaction, increase the scope of the creditor's creditor rights, resolve the issue of compulsory registration property, in case of evasion of the heir from its registration, expands the concept of "moral harm".

Legislative changes to the Civil Procedure Code were developed by the Supreme Court jointly with international experts of the World Bank.

In accordance with the amendments, the responsibility for sending or delivering copies of the legal claim and the documents attached to it to the defendant and third parties is now entrusted to the court, the term for providing the respondent with a response to the legal claim is fixed to 10 working days from the date of receipt of the copy of the legal claim, a hearing that must be initiated no later than 10 working days from the day of the completion of the preparation of the case for trial.

As a result of the discussion, the chairman of the division paid attention to strict compliance with the requirements of the legislation and the prevention of their violations, the coordinator of the Training Center - was instructed to bring the adopted changes to the attention of the regional judges and conduct similar seminars for them.
