Judges and the officers of the court of the Pavlodar region discussed the matters of execution of judicial acts

In Specialized Inter-district Economic court of the Pavlodar region the participants of the past "round table" - the judges, the leadership of the Department of Justice, and officers of the court discussed the topical issues of execution of judicial acts and application of the Law "On Enforcement Proceedings and the status of officers of the court."

Speaking at the meeting, the chairman of SIEC Rysbekov Madi noted that the stage of enforcement proceedings is essential to meet the challenges of civil proceedings, since it leads to the logical conclusion of the case and determine the effectiveness of justice. Special requirements are required by region courts to comply with the rule of law within the framework of the enforcement proceedings.

Judges of Economic Court G.Aubakirova and Yu.Ibragimova made presentations on the main matters arising from the application of the Law "On Enforcement Proceedings and Status of the officers of the court". They particularly noted that in the decisions of the officers of the court, subject to authorization, not fully covers the requirements stipulated by Article 10 of the Law "On Enforcement Proceedings and Status of the officers of the court" permitted the application of rules of law in the old version. Debtor at the termination of the enforcement proceedings out of time is excluded from the registry of debtors, which subsequently affects his rights when considering other civil cases. When temporary restrictions on debtor travel outside the country, there is a failure to provide documents proving the failure to fulfill the requirements of executive document.

During the meeting, in order to improve quality and efficiency in the execution of judicial acts by the officers of the court it is recommended to send the court properly executed executive documents.

Following the results of the "round table", the participants agreed on the need for appropriate advocacy and advice to individuals and legal entities, as well as the placement of visual reminders for the parties of enforcement proceedings.
