The Head of State signed laws regarding the Supreme Judicial Council activities and AIFC

On March 13, 2017, the Head of State signed the Constitutional Law "On Amendments and Additions to Some Constitutional Laws" and the Law "On Amendments and Additions to Some Legislative Acts of the Republic of Kazakhstan on the Activities of the Supreme Judicial Council of the Republic of Kazakhstan and Astana International Financial Center" ".

Laws are developed by the Supreme Court in fulfillment of the President's instruction for the further implementation of Plan of Nation.

The Constitutional Law amended the Constitutional Law "On the Judicial System and Status of Judges of the Republic of Kazakhstan" aimed at improving the measures taken based on the results of the periodic evaluation of the judges professional activities. In order to further improve the quality of the judiciary, to improve the assessment mechanism and to stimulate the growth of professional qualifications, amendments were made to provide for the release of a judge from the position if a negative result of a periodic evaluation of his activity was received without reassessing it.

The procedure for transferring judges to another court is regulated without a tender, if the Judicial Jury decides to transfer the judge to another court or to another specialization.

An amendment has been introduced, which makes it possible for judges retired to teaching, scientific and other creative activities in budget organizations without suspending payment of monthly life maintenance. The proposed changes will make it possible to use the practical experience of such judges in the training of judicial personnel by involving them in teaching activities at public institutions of higher education, including the Academy of Justice under the Supreme Court.

The competence of the Department on support of courts activities in order to approve the procedure for using budget funds to support the International Council activities has been regulated.

The Constitutional Law "On Astana International Financial Center" "has been amended in connection with the change in the source of financing for the AIFC. In order to ensure flexibility in the adoption of the acts of AIFC, changes have been introduced, according to which the Center's authorities have the right to issue relevant acts.

The law "On Amendments and Additions to Some Legislative Acts of the Republic of Kazakhstan on the Activities of the Supreme Judicial Council of the Republic of Kazakhstan and Astana International Financial Center" clarified the powers of the Supreme Judicial Council to consider the submissions of the Chairman of the Supreme Court on the dismissal of a judge if he refuses to transfer in another court for another specialization in making such a decision by the Judicial Jury.

The provisions of the laws will help increase the responsibility for strengthening the rule of law in the administration of justice by judges and the improvement of legislation regulating the selection of judges by judges.
