The court settled the dispute over the recovery of more than 6 million tenge in the mediation order in Zhambyl region

The Specialized Inter-District Economic Court of Zhambyl Oblast appealed to the JSC against the LLP to recover 6 204 204.30 tenge of debt, 1 013 001.02 tenge of penalty and 216 517 tenge of legal expenses.

The JSC motivated the claim by the fact that LLP having improperly fulfilled the contractual obligations assumed by the contract No. 2-09-2011 of 31.12.2010 did not pay for the consumed electricity.

During the trial the court granted the parties the opportunity to settle the dispute through conciliation procedures in order to preserve the contractual relations of the parties. As a result, the court approved a mediation agreement under the terms of which the partners entered into an agreement on mediation settlement according to which the defendant undertook to pay the plaintiff 6 204 204.30 tenge of the principal debt, pay for electricity in the terms established by the purchase agreement, the plaintiff in his turn relieved the defendant of payment of 1,013,001.02 tenge of the penalty. In the event of violation of this agreement by the defendant, he will be obliged to pay the plaintiff the amount of the principal debt and the penalty. The case was discontinued.

The plaintiff was returned 216,517 tenge of the state duty.
