Almaty regional court terminated the criminal proceedings in order of mediation

Almaty region courts actively works on increase the number of considered cases with judicial mediation and explanation of the parties in the case of the advantages of this procedure.

September 29, 2016 the judicial division for criminal cases of the Almaty regional court considered the criminal case against A.Ermekova, received on her appeal, terminated the proceedings by way of mediation.

According to the verdict of the Zhambyl district court A.Ermekova convicted under Art. 191 part 1 of the Criminal Code (robbery) to 3 years of imprisonment.

In the course of the review of the criminal case on appeal, convict and the victim submitted to the court an agreement, certified by a professional mediator A.Kistaubaev. Between the victim and the defendant held reconciliation, material and moral damage to be refunded in full and the victim has not any claims to the convict.

The Court of Appeal decided to release A.Ermekova from criminal liability on the basis of Article 68 p. 1 of the Criminal Code, i.e. in connection with reconciliation with the victim, the proceedings terminated.

The resolution came into legal force.
