The Joint Order of the Department for provision of courts' activity under the Supreme Court and the Ministry of Internal Affairs "On Approval of the Rules for Providing Pass and Intrafacility Control on the Compound and in the Buildings of the Supreme Court of the Republic of Kazakhstan, Local Courts of the Republic of Kazakhstan, the Department for provision of courts' activity under the Supreme Court of Republic of Kazakhstan (administrative office of the Supreme Court of the Republic of Kazakhstan) and its territorial bodies "(Rules).
The proposals from judges, representatives of the Advocacy and the Guild of Court Reporters were taken into account when drafting the Rules. The adoption of the Rules is dictated of information and communication technologies by the active use in the courts within the framework of the “Digital Kazakhstan” State program.
The rules regulate the procedure for providing pass and intrafacility control for visitors, participants in the process, other persons participating in the trial, as well as persons wishing to attend public hearings.
The innovation of these Rules was the definition of the notion of a "publicly accessible part of the court building", which includes waiting rooms, courtrooms, premises for receiving and issuing correspondence, and front-offices of courts.
It is in this part of the building that participants are allowed to bring in the recording devices, computers, mobile devices (cell phones, smartphones, tablets with Internet modules), computer storage media (flash cards, USB disks, etc.), and also other technical devices including wireless ones having the ability to transfer data, as well as providing access to the Internet.
The representatives of the media also have the right to enter the compound and buildings of courts with mobile devices, video, film and photo equipment. The question of their use by media representatives at court hearings is decided by the presiding judge in accordance with procedural legislation.
