Interregional workshop on work of investigating judges held in Astana court

An interregional workshop on the work of investigating judges was held in the Astana city court.

The workshop was attended by the chairman of the Judicial Board of Criminal Cases of the Supreme Court Abai Rakhmetulin, judges of the Supreme Judicial Body Askarzhan Kenzhegarin, Gulnara Mergenova, Yerzhan Dauliyev, the chairman of the city court of Astana Tlektes Barpibayev and investigating judges of the republic.

The workshop was held in order to improve the quality of the work of the investigating judges.

Opening the workshop, the chairman of the Judicial Board for Criminal Cases of the Supreme Court informed of his visit to the capital's investigative court and familiarization with the work of the investigating judge in sanctioning the covert surveillance.

A. Rakhmetulin in his speech shared the main indicators of the work of the courts called the qualitative administration of justice, timely protection of violated rights, freedoms and legitimate interests of persons involved in criminal sphere. He expressed confidence that country’s investigating judges have the potential to fulfill the tasks assigned to them by the legislation on the full implementation of the principle of protecting the constitutional rights of individuals in criminal proceedings.

The participants of the workshop - the investigating judges are instructed to pay special attention to the reasonableness in the suspicion of committing a criminal offense: reducing the excessive repressiveness of the criminal process, including by extending the scope of application of preventive measures not related to detention. It was also pointed out that the deadlines for consideration of materials should not be violated.

Summarizing the work of the seminar A. Rakhmetulin focused the attention of the judges on ensuring proper judicial control in pre-trial proceedings, excluding unreasonable sanctioning of detention, preventing them from crimes of small and medium gravity, and also checking the validity of suspicions when authorizing. It has been noted that it is necessary to ensure effective work on sanctioning of secret investigative actions, compliance with conscription, seizure of property, other powers of investigating judges as well as ensuring the adversary's side of defense and prosecution at the investigation.

At the end of the workshop, an exchange of views on the advantages of international practice, taking into account its possible application in our country took place.
