Aktobe Court №2 considered a criminal case against the citizens of the Republic of Uzbekistan T. Muratbaev, A.Beketova, B.Kulsharova and migration police employers G.Beksultanova and G.Tanbetova of committing a crime under Part 2, 3 Art. 325 p. "b", "d" of Part 3 of Art. 177, Part 2 of Art. 307 of the Criminal Code of RK (forgery, production or sale of counterfeit documents, fraud and abuse of official powers) in edition of 1997.
According to the charges, in the period from October 2010 to September 2011 in Aktobe City, A.Beketova by a group of persons with pre-planning with T.Muratbaev prepared false documents for the status of 238 repatriates. These persons, entered into a preliminary agreement with the unidentified persons during the preliminary investigation officials put stamps on the migratory cards and passports on entry into the territory of the Republic of Kazakhstan nationals of the Republic of Mongolia. They passed the documents to employees of the Office of Migration Police Department of Internal Affairs of the Aktobe region - G.Beksultanova and G.Tanbetova. Thus they made a sale of official documents, which give the right to apply to the migration police of DIA of the Aktobe region repatriate status. G.Beksultanova and G.Tanbetova, having issued quotas for citizens of Mongolia as repatriates abused their official powers. As a result of criminal acts of abovementioned persons, damage to the state is caused totaling 45,246,000 tenge.
By court sentence citizens of the Republic of Uzbekistan T.Muratbaev and A.Beketova are found guilty of forgery, production and sale of counterfeit documents and fraud (Articles 325, part 2, part 3 Art.325 and Article 177, part 3 p. "b" of the Criminal Code RK). They were sentenced to 4 years imprisonment each in a penitentiary settlement of a general regime with confiscation of property. The citizen of the Republic of Uzbekistan B.Kulsharova is found guilty of fraud (Article 177 Part 3 of paragraph "b" of the Criminal Code RK), she was sentenced to imprisonment for 3 years with suspended probation.
Migration Police employer: G.Beksultanova is found guilty of fraud and abuse of official powers (Articles 307, part 2, part 3, Article 177 paragraph "b, d"). She was sentenced to 3 years imprisonment with suspended probation and a fine of 1.512 million tenge;
G.Tanbetova is found guilty of abuse of official powers (Art.307 Part 2 of the Criminal Code of RK). She was sentenced to a fine of 1.512 million tenge.
However, by the court verdict is satisfied the victim’s civil suit, the Ministry of Health and Social Development of the Republic of Kazakhstan, for compensation for material damage in the amount of 45,246,000 tenge. The Court decide from T.Muratbaev, A.Beketova, B.Kulsharova, G.Beksultanova in solidarity order to recover the amount of 1,716,120 tenge, from T.Muratbaev and A.Beketova to recover the amount of 43,530,480 tenge in favor of the state .
It will be recalled that the Government of the Republic of Kazakhstan in the Aktobe region distributed immigration quota of repatriates in 2011 to 1000 families.
