The meeting of the Chairman of the Supreme Court of the Republic of Kazakhstan with the chairman of European Business Association of Kazakhstan took place

Today the Chairman of the Supreme Court of the Republic of Kazakhstan Kayrat Mami met the chairman of European Business Association of Kazakhstan Mark Smith.

During a meeting the parties emphasized that the creating favorable conditions for domestic business and increase of investment prospects is an actual and important problem of any state.

" Effective measures in this direction are taken in Kazakhstan. Among them, legalization of property and capital, second wave of privatization, decrease in tax burden, moratorium on checks of small and medium business. For the best defense of rights of investors in June of last year the institute of the Investment ombudsman is created" - K. Mami noted.

During conversation the Chairman of the Supreme Court of RK informed on a work of the courts on consideration of civil cases on disputes between businessmen and state bodies. So, for the last 6 years courts of Kazakhstan protected the rights of legal entities (including also foreign investors) for the total amount more than 240 billion tenge. According to judicial statistics, more than a half of all claims for contestation of actions of state bodies were satisfied. For example, in such European Union countries as Germany, Latvia is satisfied with courts from 10 to 20% of such petitions.

Now the question of creation of independent court on consideration of disputes with participation of foreign investors is considered. As the option is discussed creation of specialized board in the Supreme Court. It will allow, at higher level to resolve disputes and to exclude potential possibility of influence of regional authorities on courts.

Following the results of meeting K. Mami invited M. Smith to take part on a round table "Fair judicial system and the stable legislation – a basis of attractive investment climate" which will take place on February 6 of this year in Astana. Questions of protection of the rights of investors, settlements of disputes with their participation, improvement of the legislation in the sphere of investments will be discussed on this action

The parties emphasized importance of this meeting in the context of studying of new approaches in the sphere of legal proceedings, and also exchange of information and achievements on development of the judicial sphere. Interlocutors declared for strengthening of cooperation in judicial system.
