Court of Aktobe city reinstated in work the actor of regional Drama Theater

Court of Aktobe city considered the civil case under D.Narman legal claim to the defendant of GCE "Aktobe regional Drama Theater named after T.Ahtanova on reinstatement in work, recovery of wages during forced truancy and non-pecuniary damage.

At the trial it was established that the claimant in 2001-2015 worked as an actor of the regional drama theater named after Ahtanov. In June of 2015 it was held next certification of the theater employees, after which the complainant was sent on a business trip to Astana city. On arrival he was given paid leave, but after return to work the plaintiff learned of the order of dismissal due to the failure to pass the certification. The plaintiff went to the court to protect his violated rights.

Court, in accordance with the requirements of Art. 951 of the Civil Code of RK (pecuniary damage), taking into account the established rights violations in court, considered it necessary to recover from the defendant to the plaintiff compensation for moral damages in the amount of 60 000 tenge.

The court partially satisfied the legal claims. The order of dismissal is declared illegal and canceled the complainant reinstated in his previous work. In favor of the plaintiff, from the regional theater was recovered wages during his forced absence in the amount of 189 740tenge and moral damages in the amount of 60 000 tenge, the cost of paying the state tax in the amount of 991 and entertainment expenses in the amount of 100 thousand tenge.
