The former commander of a military unit of the Defense Ministry is convicted for embezzlement of property entrusted to him on a large scale

The commander of one of military units of the Defense Ministry, Colonel Zh.Erezhepov, being an office holder performing an organizational and regulatory and administrative functions, and entered into an agreement with him director LLP "M Barlas" E.Karibaev, making fictitious contract deliveries of building materials , stole the money than have caused state damages in the amount of 3,239,040 tenge.

The Military Court of Almaty garrison found Zh.Erezhepov guilty of committing of a crime stipulated by paragraphs "b, d" part three of Article 176 of the Criminal Code as amended in 1997, and by applying the fourth part of Article 55 of the Criminal Code has imposed two years of imprisonment with confiscation of property and deprivation of the right to hold positions in public office and local government for a period up to five year in a correction colony of a general regime. Zh.Erezhepov in accordance with the first paragraph of Article 49 of the Criminal Code is deprived of military rank - lieutenant colonel.

E.Karibaev is found guilty in committing of an offense stipulated by paragraph 1 of the third paragraph of Article 189 of the Criminal Code in the new edition, and sentenced to five years in prison. With the application of Article 63 of the Criminal Code the punishment shall consider conditional with probation for two years and six months. During the probationary convicted persons are set probationary control.

A private decree has been passed upon the case in the address of the Ministry of Defense for appropriate measures.

The sentence has not entered into legal force.
