The Supreme Court recognized the right of "Tengizchevroil" LLP to the dispute in the court of Astana

ТОО «Тенгизшевройл» оспорил в суде действия Департамента Комитета по регулированию естественных монополий и защите конкуренции Министерства национальной экономики Республики Казахстан по Атырауской области об истребовании коммерческой информации.

"Tengizchevroil" LLP has challenged in court the actions of the Department of the Committee for Regulation of Natural Monopolies and Protection of Competition of the Ministry of National Economy of the Republic of Kazakhstan in Atyrau region for the recovery of the commercial information.

Гражданское дело по данному спору было направлено судом первой инстанции в специализированный межрайонный экономический суд Атырауской области.

Верховный Суд удовлетворил частную жалобу ТОО «Тенгизшевройл», признав спор связанным с инвестиционной деятельностью, и направил дело в суд города Астана  для рассмотрения по правилам суда первой инстанции.

The civil case under the dispute was sent by the first instance court to the Specialized Inter-district Economic Court of Atyrau region.

The Supreme Court granted the private complaint "Tengizchevroil" LLP, recognizing the dispute related to investment activities, and referred the case to Astana city court for trial according to the rules of the first instance court.

Напомним, что с начала 2016 года инвестиционные споры и споры, связанные с инвестиционной деятельностью, рассматриваются Верховным Судом и судом города Астана по правилам суда первой инстанции.

Данное положение предусмотрено в новом ГПК в рамках реализации Плана нации «100 конкретных шагов» в целях защиты интересов инвесторов и улучшения инвестиционного климата в Казахстане.

It should be recalled that from the beginning of 2016 investment disputes and disputes related to investment activities are considered by the Supreme Court and the court of Astana on the rules of the first instance court.

This provision provided for in the new Code of Civil Procedure in Plan of Nation "100 concrete steps" to protect the interests of investors and improve the investment climate in Kazakhstan.
