In Kostanay the Court recovered from father in favor of a disabled child treatment costs in the amount of 5 mln. KZT

Resident of Kostanai went to the court with a legal claim to the former spouse for the recovery of expenses actually incurred for the treatment of minor son born in 2000.

The child is disabled the third group, with the birth of a boy is completely deprived of hearing. After divorce, the mother was forced to carry out a comprehensive survey in Germany, then in Moscow several times to treat, as well as purchase a cochlear implant cost more than 25 thousand US dollars, surgeon from Austria made the operation the child. Maintenance and repair of hearing aids cost a woman as for a large sum. The total cost of treatment of the son was 9.5 million tenge.

The child's father does not agree with the presented legal claim, in particular - with the currency rate against the tenge. As it turned out, he not only did not help with the cost of treatment, but did not pay alimony. According to the decision of the officer of the court, arrears of alimony made over the past five years - 708 000 tenge. His unwillingness to pay the man explains that he has another family, which also has a son at the age of 12 years. As explained by the defendant, he works as a driver in a private entrepreneur, and his salary is only 23 thousand tenge.

In accordance with the requirements of Article 144 of the Code of RK "On Marriage (Matrimony) and Family" in exceptional circumstances (serious illness, injury, minor children, need to pay for nursing care for them and other circumstances), each of the parents may be held by the court to participate in the bearing the additional costs caused by these circumstances.

Upon review of the civil case, the court decided to satisfy the legal claim of the defendant citizen K. partially. Namely, to collect in her favor the amount of incurred expenses in the amount of 4 million. 750 thousand tenge. The court also ordered to recover from the defendant to the plaintiff an additional monthly cost of maintaining a son of five MRP to his full recovery.
