Discussion of the new Administrative Offences Code

In Kyzylzhar district court of North Kazakhstan region held a roundtable discussion on "Discussion of the new Administrative Offences Code." The event was attended by employees of prosecutors, enforcement bodies, bailiffs, employees of the tax administration, justice, and the mass media representatives

Opening the roundtable, the district court judge Dinara Dairova noted that the new Administrative Code substantially modified procedure for the considering  of administrative cases, simplified administrative proceedings, introduce incentive mechanisms for payment of the fine, cut of an administrative offense for which the person to be imposed an administrative penalty in the form of administrative detention .

Administrative legislation is humanized. Administrative penalty in the form of warnings are increased by seven per cent, the amount of fines for small businesses and natural persons reduced by half.

It has excluded completely the measure of administrative and legal exposure as compulsory medical measures.

Regarding the main novellas participants noted that the new Code also is provided for an independent chapter 44 on the appeal of actions (inaction) of the body (official), conducting the proceedings of an administrative offense. This line is not present in the current Code. 

Roundtable participants discussed the application of the provisions of the updated Administrative Offences Code in the legal practice of courts, law enforcement and state bodies.

Following the event, developed general measures on the interaction of state bodies in order to further improve unified enforcement practices on Administrative Offences.
