Information about the rules of professional ethics of judicature

Decree of the President of the Republic of Kazakhstan dated May 3, 2005 N 1567

 

"The Code of Honor of civil servants of the Republic of Kazakhstan"

       In order to increase the requirements for moral character and business skills of public servants, DECREE:

       1. To approve the Code of honor of civil servants of the Republic of Kazakhstan (Rules of professional ethics of civil servants).

       2. Repealed:

       1) Decree of the President of the Republic of Kazakhstan dated January 21, 2000 N 328 "On approval of the rules of official ethics of civil servants of the Republic of Kazakhstan" (SAPP Republic of Kazakhstan, 2000, N 2, p. 16);

       2) Decree of the President of the Republic of Kazakhstan dated May 7, 2002 N 866 "On amendments and additions to the Decree of the President of the Republic of Kazakhstan dated January 21, 2000 N 328" (SAPP of the Republic of Kazakhstan, 2002, N 14, art. 137).

       3. This Decree comes into force from the date of signing.

Code of honor of civil servants of the Republic of Kazakhstan

(Rules of professional ethics of civil servants)

       Footnote. Code of Honor as amended Presidential Decree of 01.04.2011 № 1180.

 

1. General

 

       1. Public service, being an expression of the special confidence of the society and the state, makes high demands on the moral and ethical image of civil servants.

       The society expects that the civil servants will devote all their strength, knowledge and experience in their professional activities, serving their Motherland impartially and honestly - the Republic of Kazakhstan.

       2. This Code of honor of civil servants of the Republic of Kazakhstan (Rules of professional ethics of civil servants) (hereinafter - the Code) establishes the basic standards of behavior for civil servants of the Republic of Kazakhstan in accordance with the Law of the Republic of Kazakhstan dated July 23, 1999 "On State Service", the Law of the Republic of Kazakhstan dated July 2, 1998 “On combating with corruption "and generally accepted ethical standards.

       3. Heads of state bodies in the central executive bodies - executive secretaries of central executive bodies or officials, assigned the responsibility of the executive secretaries of the central executive bodies, in the absence of the executive secretaries of the central executive bodies or the officials, heads of central executive authorities enforce the requirements of this Code and provide the placement of the text of this Code in places accessible for public viewing in the buildings of state bodies .

       4. Civil servant must be familiar with this Code in writing within one month after receipt of the civil service.

 

2. General rules of behavior for public servants

5. Civil servants must:

1) To be committed to the policy of President of the Republic of Kazakhstan and consistently implement it, strengthening the authority of the government and avoid actions which may discredit the institutions of the state;

2) To be governed by the principle of legality, the requirements of the Constitution, laws and other normative legal acts of the Republic of Kazakhstan;

3) To work for the benefit of society and the state;

4) To counter the actions, which take the interests of the state, preventing the effective functioning of the public authorities;

5) To take care of the entrusted public property and to use it efficiently and effectively;

6) To ensure respect  and protection of the rights, freedoms and lawful interests of individuals and legal entities, to prevent bureaucracy and red tape during legal investigation of their applications, to take the necessary measures on the appeals on time;

7) To maintain and strengthen public confidence in the civil service and state institutions;

8) Not to give cause by their actions for well-founded criticism from society, to avoid persecution for criticism, to use constructive criticism for correction of deficiencies and improvement of their performance;

9) To be honest, fair, modest and polite, to comply with generally accepted ethical standards;

10) To promote unity of the people of Kazakhstan and ethnic harmony in the country, respect the state and other languages, traditions and customs of the people of Kazakhstan;

11) To comply with state and labor discipline strictly, to manage legislative authority effectively; to perform their duties faithfully, impartially and efficiently; to use of working time rationally;

 12) To make the necessary efforts to highly professional work, and to apply the optimal cost-effective ways to tasks;

13) To counter the actions, preventing the proper performance of duties by public servants;

14) To avoid any selection and placement on the grounds of kinship, communities and personal devotion;

15) To pinpoint the problem and scope of official authority of subordinate employees, not to give orders clearly unrealistic, not to require subordinate employees to fulfill orders beyond their official duties;

16) Not to allow unfounded allegations, facts rudeness, humiliation, lack of tact towards subordinates workers; 

17) Not to coerce subordinate employees to commit illegal acts or offenses that are not compatible with the generally accepted moral and ethical standards;

18) To have the necessary level of training, including on issues related to the execution, which functional responsibilities are connected with subordinate employees;

19) To prevent and suppress violations of professional ethics by other public servants;

20) To adhere to the dress code during the performance of their duties.

6. Государственные служащие должны соблюдать деловой этикет, уважать правила официального поведения.

6. Civil servants must comply with business etiquette; respect the rules of official standards of behavior.

7. Civil servants are not allowed to use their position and related opportunities in the interest of public and religious associations and other non-profit organizations, including the promotion of their attitude towards them.

 Civil servants, holding leadership positions, are not allowed to coerce subordinate employees to participate in the activities of public and religious associations and other nonprofit organizations.

 

3. Anticorruption behavior civil servants

 8. Civil servants must confront manifestations of corruption, prevent corruption offenses or offenses involving corruption or creating conditions for corruption.

 Public servants must stop the facts of corruption offenses by other public servants.

 

9. If a civil servant has reliable information about a corruption offense, he must take the necessary measures to prevent and stop such an offense.

The necessary measures are informing the authorized state bodies and informing superiors leadership of the state body.

After receiving information about a corruption offense, public authority takes appropriate action on, including for the protection of a public servant if his actions are no violations of the law against unlawful harassment, which negatively affects the further official duties of the civil servant, his rights and legitimate interests.

10. Civil servants must avoid administrative and other impediments by their actions and decisions to the implementation of individuals and legal entities of their rights and legitimate interests. If case of detection of any such evidence, public servants must take measures to eliminate them.

11. Civil servants must endeavor to prevent economic damage to the state, to prevent the initiation of control checks in their personal interests and the interests of third parties.

12. Civil servants are not allowed to use their official powers and related opportunities for personal property and non-profits.

13. Civil servants must take measures to prevent conflicts of interest.

14. If there is a conflict of interest, in other words, when there is a contradiction between the personal interest of a public servant and proper performance of his official authority or the legitimate interests of individuals and legal entities, the state, which could lead to harm these legitimate interests, the civil servant must take measures for its prevention and resolution, provided by the legislation of the Republic of Kazakhstan on public service.

 

4. Public Speaking

15. Public Speaking on the activities of public authority is carried out by head or authorized officials of the public authority.

Civil servants must conduct discussions in the correct manner, without undermining the authority of the civil service.

16. Civil servants should not publicly express their views on public policy issues and performance, if it:

       1) does not correspond to the main directions of state policy;

       2) discloses proprietary information, which is not permitted to make public;

       3) contains unethical statements to the officers of the state government, other public servants.

 17. Publications are not allowed by public officials on behalf of a public authority on matters, which are not related to the conduct of public policy, public authority and activities of civil servants. Publication of materials on teaching, research and other creative activities can be carried out by civil servants only as a private individual.

 

 18. Upon presentation to the civil servant unreasonable public corruption charges, including involvement in business activities, lobbying anyone's interests, as well as the illegal acquisition of income and property income from disparate civil servant, he must take measures for its refutation, including the courts within one month from the date of detection of such charges.

5. Behavior of civil servants during off-duty time

19. Civil servants during off-duty time must conform to generally accepted ethical standards, to prevent cases of antisocial behavior.

20. Civil servants must show modesty, not to stress and to use the official position of civil servants on delivery vehicles, service and other services that do not give rise to legitimate criticism of society.
